Child custody and child support issues associated with divorce can be contentious. Our Dallas divorce lawyers understand the intricacies of Texas divorce law pertaining to children. We serve our clients by offering sound legal advice and representation that focuses on keeping the family relationship with your children intact.
Texas is a “no-fault” divorce state, though petitioners can petition for a fault-based divorce in cases where doing so is necessary or advantageous. Similarly, spouses may agree on much or all of the division of assets or may be far apart on what each spouse feels is fair. GBA Family Law’s divorce attorneys in Dallas represent our clients’ best interests by focusing on their desired outcomes while simultaneously helping them to make informed choices and consider reasonable compromises that will lead to a finalized divorce decree.
The divorce process begins when one spouse files an Original Petition for Divorce with the court in the county where they reside (Dallas, Rockwell, Kaufman, Ellis, Denton, or any of the other surrounding counties). The petition filer is known as the petitioner, and the spouse receiving the petition (via being served notification, usually by someone from the local sheriff’s office) is the respondent, though both spouses can also decide to file together as joint petitioners.
One of the spouses in the divorce must be a Texas resident for at least six months and have been a resident in the county in which the petition is filed for no less than the preceding 90 days.
A Suit Affecting the Parent-Child Relationship is added to the divorce petition for spouses with children.
How the divorce proceeds depends on whether the petitioner and respondent agree on most or all of the issues or if there are significant disagreements. Mediation can often help resolve issues and keep both parties out of court. Your Dallas family attorney will negotiate with your spouse’s legal representation with your instruction.
If the parties to the divorce are unable to come to an agreement, any outstanding issues may be litigated in court. In court, your lawyer will present your case and make all arguments on your behalf. Your spouse’s lawyer will do the same for your spouse. At the end of the proceedings, the judge will take all arguments into consideration and issue a decree that both parties must sign before the divorce is finalized.
Whether it’s an acrimonious split or amicably deciding to part ways, divorce is never easy. Hiring the best divorce lawyers in Dallas you can is the first step toward a successful resolution so that you can concentrate on your future. Our family law practice was built on the understanding that to best serve our clients, we must offer unparalleled representation, and when you hire a family law attorney in Dallas from our firm, we’ll be there every step of the way to guide you toward making the best possible decisions.
