How Is Your Stock Portfolio Divided in a Divorce?

Katie Flowers Samler | April 3, 2024

If you own shares of stock and are getting a divorce, the first thing to determine is whether you need to divide your portfolio with your spouse. Often, your shares will be considered community property, meaning that they’ll need to be divided, but if they are actually separate property, then you’ll get to keep all of your stock.

If your stock portfolio is part of the pool of assets that need to be split with your spouse, this can be done in two different ways. You may end up dividing up the portfolio, giving some shares to your spouse and keeping some for yourself. Or one spouse might get all of the stocks, while the other spouse gets other assets with an equivalent value.

A skilled divorce attorney like the ones at Goranson Bain Ausley can help to determine whether your stocks need to be divided and, if so, how best to go about it, taking your unique life circumstances into account. Contact us today to set up a consultation with an experienced divorce lawyer.
