Texas Child Support Cap Increasing September 1, 2025

Under the Texas Family Code, the maximum amount of monthly income used to calculate child support, commonly called the “cap” is reviewed and adjusted every six years.

Currently, the cap is $9,200. This means that if you are ordered to pay child support (the “obligor”) and your monthly net resources exceed $9,200, child support is calculated only on that $9,200 figure, not your full income. The exact percentage applied depends on the number of children being supported.

What’s Changing

Beginning September 1, 2025, the cap will increase to $11,700.

This change will apply to:

  • All new cases filed on or after September 1, 2025
  • Any child support case still pending as of September 1, 2025

New Maximum Child Support Amounts

If the new cap applies to your case, the maximum monthly child support obligations will be:

  • 1 child: $2,340
  • 2 children: $2,925
  • 3 children: $3,510
  • 4 children: $4,095
  • 5 children: $4,680

(These numbers reflect the statutory percentages applied to the $11,700 cap.)

Why the Timing Matters

If your child support case is pending on or after September 1, 2025, the higher cap will apply. Because of this, some individuals may benefit from resolving their child support case before September 1, 2025, in order to have the current $9,200 cap govern their obligation.
