How to File a Divorce Appeal: Understanding the Appeal Process in Texas

Clint Westhoff | March 8, 2024

If you’re not satisfied with the outcome of your divorce settlement, the appeal process may offer you an opportunity to secure a better result. However, it’s important to understand both how to file a divorce appeal and when it’s appropriate to do so.

When Can I Start the Divorce Appeal Process?

In most cases, you’ll need to wait until your final divorce order is issued to begin an appeal. Once your case is finished and you have the final order, you have 30 days to appeal the court’s ruling. In limited circumstances, you may be able to appeal parts of the case as it is litigated, but this is the exception, not the rule.

How Can I Win My Divorce Appeal?

The process of appealing a divorce successfully focuses on being able to show that the trial court made errors in your case that affected its outcome. While a successful appeal is never guaranteed, having a knowledgeable attorney who can spot these errors and point them out to the appeals court improves the odds of a favorable result.
