How to Get Divorced in the Least Destructive Way

Going through a divorce is one of the most emotionally and financially challenging life events you can experience. To minimize stress during divorce, it’s important to speak to an attorney who can outline your next steps and work together to make your goals a reality. Understanding how to move forward helps keep fear and uncertainty at bay, which can set you up to make informed financial decisions and can help you reduce tension between you and your spouse.

What can we do to help mitigate financial and emotional damage as we go through the divorce process?

Set a goal. Consider what would you like your life to look like six months from now, a year from now, five years from now. Where are you? What’s your relationship with your kids? What’s your relationship with your ex-spouse? With the help of your attorney, you can figure out how to get from where you are today to meeting the goals you would like to achieve over the coming months and years.

Gather information. The first step in achieving your goals is to gather information. Do you and your attorney have all the information needed to decide about settlement terms in your case? If the answer is no, then the information must be gathered. There are a few ways this can be done, and a lot of it depends on the cooperation of your spouse. If your spouse is cooperative, the information-gathering process can be more informal, easier, and cheaper. However, if your spouse is not forthcoming with information, you may have to engage in more formal or intensive discovery processes such as subpoenas and depositions.

Make decisions. Once gathering the information, you and your attorney can make informed decisions about the outcome of your case and how to come to a resolution with your spouse. There are many ways to do this, from kitchen table negotiation to attorney negotiation, mediation, and of course, litigation. With your attorney, you can weigh your options and try to figure out again, the least destructive to your finances and to your relationships option, that we can achieve those goals.
