Meet Kristal Thomson: Strategy, Judgment and a Personal Approach to Family Law

We sat down with Kristal to talk about what makes family law in San Antonio distinctive, why the most aggressive approach isn’t always the most effective one, and what she wants clients to understand when facing one of the most consequential transitions of their lives.

You’ve practiced family law in San Antonio for more than 20 years. What makes this community different?

San Antonio is a “small, big city.” It’s a major metropolitan area, but relationships still matter here. Professional, social and business circles frequently overlap, and that can be especially important for clients with significant assets, business interests or reputational concerns.

The legal community has its own character as well. San Antonio tends to be more relationship-driven and less formal than some larger markets. Understanding the lawyers, the courts and how cases tend to unfold here can make a meaningful difference in developing the right strategy.

What kinds of clients and cases are the best fit for your practice?

Many of my clients are facing a divorce after a long marriage or have significant assets, business interests, trusts or complicated property issues. Others are dealing with difficult custody matters or family dynamics that require particular care.

What these cases tend to have in common is that there isn’t a simple answer. The client needs someone who can look beyond the immediate legal issue and consider the financial, personal and family consequences of the decisions we’re making today.

You’ve said you have no desire to “start a fire” in a case. What do you mean by that?

Clients sometimes come to me believing they need the most aggressive lawyer they can find. I understand that instinct, particularly when they’re hurt, angry or frightened about what comes next. But creating conflict for the sake of appearing aggressive rarely benefits the client.

That doesn’t mean I’m reluctant to litigate. If a case needs to be tried, I’m fully prepared to try it. But I want to be strategic about where we fight and why. I don’t take positions that aren’t supported by the law, and I don’t escalate a dispute simply to escalate it.

Sometimes the strongest strategy isn’t the loudest one.

How do you help clients make decisions when emotions are running high?

I tell clients that knowledge is power. My job is to give them the information they need to make good decisions: what the law supports, where we have leverage, where a position may not succeed, how a judge may view an issue and what the longer-term consequences of different choices might be.

I can advise, educate and advocate, but ultimately these are deeply personal decisions. My clients are the ones who will live with the outcome. I want them to understand their options well enough to make those decisions with confidence.

How do you decide whether to negotiate, mediate or take a case to trial?

It starts with the client’s goals and the facts of the case. There isn’t one approach that’s right for everyone.

Some cases can be resolved thoughtfully without unnecessary escalation. Others require strong litigation because there is a fundamental disagreement, an unreasonable position or something important that needs to be protected.

Experience helps you recognize the difference. The objective isn’t to avoid a fight at all costs or to fight at all costs. It’s to choose the approach most likely to achieve what matters to the client.

Why is discretion particularly important for some San Antonio clients?

Because this is such a connected community. For business owners, executives, professionals and prominent families, a divorce doesn’t necessarily exist separately from the rest of their lives. Business relationships, friendships and professional reputations can intersect.

Many people come to me because someone they trust recommended me. They may talk to a friend, another lawyer or a professional advisor before they ever search for a family lawyer online.

For those clients, discretion isn’t an added benefit. It’s an expectation.

What do you wish more people understood before beginning a divorce?

Don’t set your expectations based on someone else’s divorce.

Friends and family usually mean well, but every case is different. Two divorces can sound similar and involve completely different financial circumstances, family dynamics, legal issues and judges.

Your strategy should be built around your facts, your priorities and the life you want to have when the case is over—not what happened in someone else’s case.

After more than two decades in family law, what do you believe clients need most from their lawyer?

Judgment and perspective.

Technical legal knowledge is essential, particularly in complex cases. But clients also need someone who can help them separate what feels urgent today from what will actually matter a year or five years from now.

I want my clients to understand what we can control, what we can’t, and where their energy and resources are best spent. If I can give them clarity during a time when very little feels clear, they are better positioned to make decisions that protect what matters and move forward.
